Are Court Records Public in Harlan County?
Kentucky law starts from the assumption that court records are open to the public. Under KRS 171.410(1) and the standards set by Kentucky Supreme Court rules, documents produced during judicial proceedings are available for public inspection unless a specific exemption applies. Vital records — birth, death, marriage, and divorce certificates — fall under a separate set of rules. KRS 213.131 limits access to the people named on those documents, their authorized legal representatives, or someone acting under a court order. Birth records don't become fully public until 100 years after the date of birth. Death records stay restricted for 50 years from the date of death.

Background Checks
The Administrative Office of the Courts (AOC) runs the AOC FastCheck system, which offers two types of searches: self-searches for individuals checking their own records, and third-party searches for employers and agencies with a permissible purpose. The Kentucky State Police separately offers name-based criminal history checks for a $20 fee, payable by check or money order to the KY State Treasurer.
Arrest and Booking Records
Arrest records and booking information come from law enforcement, not the court clerk. The Harlan County Sheriff's Office is the primary agency for unincorporated areas of the county. The District Court covers civil disputes of $5,000 or less, small claims up to $2,500 under KRS 24A.230, landlord-tenant cases, and voluntary or involuntary mental health commitment proceedings. The Circuit Court takes everything above the District Court's monetary limit, including major contract disputes, personal injury claims, and civil appeals from District Court.

Divorce Records
Under KRS 213.131, divorce records are restricted. Only the parties named on the record — or someone holding a court order — can access them. If you're eligible, contact the Circuit Court Clerk with your case-identifying information and a valid photo ID. Standard copy and certification fees apply.
Marriage Records
Marriage licenses and certified copies come from the Harlan County Clerk, not the Circuit Court Clerk. A certified copy costs $5.00 in person or $6.00 by mail. The license fee itself is $50.00. Both parties must appear together with valid government-issued identification. There is no waiting period.

Birth and Death Records
Vital records for births and deaths in Harlan County are maintained by the Kentucky Office of Vital Statistics, a division of the Cabinet for Health and Family Services. Certified birth certificates carry a non-refundable $10.00 search fee per certificate. Death, marriage, and divorce certificates obtained through the state Office of Vital Statistics cost $6.00 each. Keep in mind that birth records are restricted for 100 years after the date of birth, and death records for 50 years after the date of death, per KRS 213.131.
Adoption Records
Adoption records are confidential under Kentucky law. Petitions and related filings from adoption proceedings are sealed from public access, regardless of when the case was concluded. A standard public records request will not produce these documents.
Harlan County Probate Court Records
In Kentucky, probate jurisdiction belongs to the District Court, not the Circuit Court. The Harlan County District Court — located in the same Justice Center — handles all estate matters for people who were living in the county at the time of death.
