Are Court Records Public in Bullitt County?
Kentucky’s Open Records Act (KRS 61.870 to 61.884) establishes that records maintained by public agencies — including courts — are accessible to residents of the Commonwealth. Requesters do not need to state a purpose or present identification to inspect or copy court records. The Bullitt County Circuit Court Clerk’s Office follows these statutory requirements and provides copies of public records upon request and payment of applicable fees.
The Kentucky Supreme Court has also issued an Open Records Policy that governs access to administrative records held by the court system. Together, these frameworks create broad public access with specific exceptions.
Records restricted from public access include:
- Documents protected by attorney-client or other legal privilege
- Juvenile case records
- Records sealed by court order
- Mental health case records
- Domestic violence case records (in the context of AOC background reports)
- Information whose disclosure could jeopardize a person’s right to a fair trial
- Sensitive personal identifiers such as Social Security numbers and bank account information
- Records designated confidential under specific federal or state statutes
- Trade secrets and proprietary business information
When a record is partially restricted, the custodian will typically redact the protected portions and provide access to the remainder. Individuals who believe a records request has been improperly denied may appeal to the Kentucky Attorney General’s Office, which has authority to review open records disputes.
